Terms of Service

1. Acceptance of Terms

By accessing or using Cercle, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Cercle is a family-organization and record-keeping platform. Its services include:

  • Family care coordination through care circles
  • A family-entered medication copy and optional convenience reminders
  • Shared calendar for appointments
  • Links to public and community resources in Quebec
  • Information on government programs and benefits

3. User Account

To use certain features of Cercle, you must create an account. You are responsible for maintaining the confidentiality of your login information and for all activities under your account.

You agree to provide accurate and complete information when creating your account and to keep it up to date.

You must be at least 18 years old to create a Cercle account. By creating an account, you confirm that you are at least 18 years of age. If we learn that a user is under 18, we will delete their account and data in accordance with our Privacy Policy.

4. Acceptable Use

You agree not to:

  • Use the service for illegal purposes
  • Share false or misleading information
  • Attempt to access other users' accounts
  • Interfere with the operation of the service
  • Collect data from other users without authorization

5. Health Information

Cercle is intended only for family organization and record-keeping. It is not intended for diagnosis, treatment, clinical monitoring, medication administration, dose decisions, or emergency response. In a medical emergency, call 911. For health guidance in Quebec, call Info-Santé at 811.

Cercle allows you to store sensitive health information. While we take significant security measures to protect this data, you acknowledge that:

  • Family-entered information may be incomplete, delayed, or incorrect and must be verified against the current source
  • Cercle does not provide medical advice
  • You should always consult qualified healthcare professionals
  • Medication reminders can be delayed, duplicated, or missed and must not be the only basis for taking, omitting, repeating, or changing a dose
  • Cercle does not check drug interactions or submit pharmacy requests; contact a pharmacist directly

6. Data Ownership

You retain rights in the information you enter into Cercle. You can export your personal information and authorized shared-circle data, and you can delete your account through account settings. Account deletion revokes your access immediately and removes or anonymizes data according to the Privacy Policy; records shared with other accepted care-circle members may remain available to them.

7. Right to Object (Bill 25)

In accordance with Quebec's Bill 25, you may object to the processing of your personal information on legitimate grounds by contacting privacy@carecercle.com.

8. Intellectual Property

All content on Cercle, including text, graphics, logos, and software, is the property of Cercle or its licensors and is protected by Canadian intellectual property laws.

9. Limitation of Liability and Indemnification

Cercle is provided "as is" without warranty of any kind. We do not guarantee that the service will be uninterrupted or error-free. In no event shall Cercle be liable for any indirect, incidental, or consequential damages. Our total liability to you shall not exceed the total amount you have paid for the service in the preceding twelve (12) months.

You agree to indemnify and hold harmless Cercle, its officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from: (a) your use of the service; (b) your violation of these terms; (c) any inaccurate information you provide; (d) any medical or care decisions made in reliance on information from the service.

10. Force Majeure

Cercle shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, internet service disruptions, power outages, government actions, or failures of third-party service providers.

11. Modifications

We reserve the right to modify these terms at any time. Changes will take effect upon posting on this page. Your continued use of the service after posting constitutes acceptance of the new terms.

12. Termination

We may suspend or terminate your access to the service at any time, for any reason, including violation of these terms. You may also terminate your account at any time by contacting us.

13. Governing Law

These terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada. Any dispute shall be subject to the exclusive jurisdiction of Quebec courts.
